The Ontario Employer’s Checklist: Navigating ESA, OHSA, and WSIB in 2026
In Ontario, "I didn’t know" isn't a legal defense. Whether you’re hiring your first team member in Guelph or managing fifty in Ottawa, you are entering a regulated relationship governed by three major pillars. As of March 2026, here is your essential compliance checklist.
1. The Employment Standards Act (ESA) Updates
The ESA is the "floor" for worker rights, and 2026 brought significant changes for any employer with 25 or more employees:
Job Posting Transparency: You must now include the expected compensation (or a range up to $50,000) in all public job postings.
AI Disclosure: If you use Artificial Intelligence to screen or select applicants, you must state this clearly in the posting.
Minimum Wage: The general rate is currently $17.60/hour (effective since Oct 2025). Expect the next adjustment announcement this April for October 1, 2026.
2. Health & Safety (OHSA) and the "Washroom Rule"
New for 2026, the Occupational Health and Safety Act now requires employers to maintain visible cleaning records for washroom facilities accessible to workers. You must display the date and time of the two most recent cleanings.
Safety Training: Ensure all staff have completed the "Worker Health and Safety Awareness in 4 Steps." It’s a one-time requirement, but audit-critical.
3. WSIB: Record-Low Rates but Faster Reporting
Good news: The average premium rate for 2026 has dropped to $1.23 per $100 of payroll—the lowest in 50 years.
The 3-Day Rule: You must now report a work-related injury to the WSIB within three business days of learning about it.
Maximum Earnings: The ceiling for insurable earnings has risen to $121,700 for 2026.
